This website is operated by BLANKLIVING LLC, doing business as BALAVIC® (collectively, “BALAVIC,” “we,” “us,” or “our”). BALAVIC offers this website, including the information, tools, products, digital resources, and services available through it (collectively, the “Service”), conditioned upon your acceptance of these Terms of Service (“Terms”) and all policies and notices referenced here.

By visiting our website, using the Service, or purchasing from us, you agree to be bound by these Terms, including any additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the website, including browsers, customers, vendors, merchants, and contributors of content.

Please read these Terms carefully before accessing or using the website. If you do not agree to these Terms, you may not access the website or use the Service.

The BALAVIC mobile messaging program is operated by BLANKLIVING LLC, doing business as BALAVIC. By enrolling in the program, you agree to these mobile messaging terms.

By consenting to receive SMS or text messages from BALAVIC, you agree to receive recurring messages at the mobile number you provided, including messages sent using automated technology. Messages may include order information, customer-service communications, cart reminders, promotions, specials, and other marketing offers.

Consent to receive marketing text messages is not a condition of purchase. Participation is voluntary. BALAVIC does not charge for text messages, but message and data rates may apply under your wireless plan. Message frequency varies.

You may opt out of marketing text messages at any time by replying STOP to a BALAVIC text message. You may also revoke your consent through another reasonable method, including by emailing [email protected]. You may reply HELP for assistance. After an opt-out request, you may receive a one-time confirmation message.

We may change the telephone number or messaging service used for the program. Wireless carriers are not responsible for delayed or undelivered messages. You are responsible for providing a valid mobile number and updating it if your number changes.

To the extent permitted by law, BALAVIC is not liable for failed, delayed, or misdirected messages, errors in message content, or actions taken or not taken in reliance on a message.

3. General Conditions

We reserve the right to refuse or discontinue the Service to anyone when permitted by law.

Information you submit through the website may be transmitted over various networks and modified as necessary to meet technical requirements. Payment-card information is handled by third-party payment processors and is encrypted during transmission in accordance with their security practices.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, access to the Service, website content, digital resources, or contact made available through the Service without our express written permission.

Certain products, digital resources, or services may be available exclusively online and may have limited quantities. Returns, refunds, and exchanges are governed by our Refund Policy.

We make reasonable efforts to display product colors and images accurately, but device displays and photography may affect how colors and details appear.

We may limit sales by person, household, order, geographic region, or jurisdiction and may limit product quantities on a case-by-case basis. Product descriptions, availability, and prices may change without notice. We may discontinue a product or offer at any time. Offers are void where prohibited.

Digital downloads, printable materials, guides, scorecards, playbooks, and other digital resources are licensed for the purchaser’s personal, noncommercial use unless the product page expressly states otherwise. They may not be resold, redistributed, uploaded to another platform, shared publicly, or used to create competing products without our written permission.

Except as expressly stated in a product description, we do not guarantee that a product, resource, or service will meet every individual expectation or that all errors will be corrected immediately.

7. Billing and Account Information

We may refuse, limit, or cancel an order at our discretion when permitted by law. Restrictions may apply to orders placed by the same customer account, credit card, billing address, shipping address, or household. We may limit or prohibit orders that appear to be placed by dealers, resellers, distributors, or for fraudulent or unauthorized purposes.

We are not obligated to keep unsolicited Submissions confidential, pay compensation for them, or respond to them.

We may monitor, edit, or remove content that we reasonably determine is unlawful, offensive, threatening, defamatory, obscene, misleading, infringes another party’s rights, or violates these Terms.

Your Submissions must not violate another party’s copyright, trademark, privacy, publicity, or other rights; contain unlawful, abusive, obscene, or malicious material; or misrepresent your identity or the origin of the Submission. You are responsible for the accuracy and legality of the content you submit.

12. Errors, Inaccuracies, and Omissions

To the fullest extent permitted by law, BLANKLIVING LLC, BALAVIC, and their owners, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from use of the Service or products obtained through it.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. In jurisdictions that do not permit certain exclusions or limitations, our liability will be limited to the maximum extent permitted by law.

15. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless BLANKLIVING LLC, BALAVIC, and their owners, officers, employees, affiliates, agents, contractors, licensors, service providers, suppliers, and representatives from claims, liabilities, damages, losses, and reasonable attorneys’ fees arising from your breach of these Terms, violation of law, or infringement of another party’s rights.

16. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the unenforceable portion will be severed. The remaining provisions will remain valid and enforceable.

These Terms remain effective until terminated by you or us. You may terminate your agreement to these Terms by ceasing to use the Service.

If we reasonably believe that you have violated these Terms, we may suspend or terminate your access to the Service without notice when permitted by law. Obligations and liabilities incurred before termination will survive termination, including amounts owed for completed purchases.

18. Entire Agreement; No Waiver

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms and any separate agreement under which we provide the Service will be governed by and construed in accordance with the laws of the State of Nebraska, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
